Introduction

The Ministry of Justice and Constitutional Affairs (MoJC) is mandated both to coordinate the implementation for the justice and corrections sector reform initiatives, Drafting legislations, coordinate legal aid/Legal education providers, bar associations and also processing the provisional Constitutional review and implementation procedures. In order to contrivance review process in active and determinate way the ministry is recruiting following five persons who have a capacity to realize the constitutional review process strategies.

Terms of References (TOR)

 

    Position 1: Constitutional Development Department Manager

The Constitutional Development Department Manager will be responsible for the overall management and capacity development of the Department. To this end, the Manager will:

    Provide technical advice and other support to the Minister in the area of constitutional affairs;
    Develop finalize and oversee implementation of an action plan to guide the work of the Department in support of the MOJCA’s overarching Annual Plan 2014;
    Manage and oversee the work of the four advisors under this LOA, namely the Legal Advisor (Constitutional Affairs), Constitutional Coordination Advisor, Civic Education Advisor, Communication, Media and Public Awareness Advisor;
    Develop and oversee implementation of an institutional capacity development strategy for the Department, including a detailed action plan for implementation of the strategy with options and clear recommendations. This strategy and plan will be based on a capacity and training needs assessment as appropriate, noting the existing limited staff in the Department;
    Develop and oversee implementation of a capacity development and supervision plan for the graduate interns who will work at the Department during the course of the LOA;

 

Academic qualifications and Experience

    Minimum of a master’s degree in governance, law, management, politics or a related discipline;
    At least 5 years of relevant experience in governance, management, politics or constitutional affairs;
    Proven background in capacity development and management, preferably within the public sector;
    Experienced at drafting reports, briefings and training materials
    Sound demonstrated understanding of gender issues and principles;
    Fluency in Somali and English (written and oral).

 

Preferred Attributes:

        Client Orientation – Ability to identify and analyze clients’ needs and provide appropriate solutions to meet business requirements;

    Position 2: Constitutional Coordination Specialist

While the National Federal Parliament is constitutionally mandated to run the overall constitutional review process in accordance with Article 134 of the Provisional Constitution, the MOJCA has the lead within the Executive branch for supporting constitutional affairs and constitutional implementation in particular. Within this overall remit and while working closely with all other Specialists within the Constitutional Development Department, the Constitutional Coordination Specialist will:

    Support the Minister and the CDD Manager to coordinate all constitutional affairs issues within the Executive branch, including supporting the Minister to provide briefing and advice to the Prime Minister and Council of Ministers as required;
    Act as the MOJCA focal point for Vision 2016 and support the Minister and Department to carry out its responsibilities in support of implementation of Vision 2016, including representing the Ministry at workshops and events on Vision 2016 mainstreaming and disseminating information on progress made in Vision 2016 mainstreaming within the MOJCA;
    Act as the MOJCA focal point for the New Deal Compact State building and Peacebuilding Goal 1, including in relation to all state formation, national reconciliation, constitutional affairs and electoral issues;
    Develop a policy document, to be endorsed by senior management, which provides a framework – the mandate, objectives and priorities – for the work of the Department in implementing PSG-1 and Vision 2016 (using consultants or other resources as necessary), and a supporting action plan designating responsibilities and timelines for implementing priorities within MOJCA
    Develop and overseeing the Ministry’s relationship with donors in relation to constitutional affairs, including supporting the Minister to provide regular briefings to donors and other development partners;
    Proactively maintain the MOJCA’s relationship with Parliament and its key constitutional committees in support of overall constitutional implementation;
    Proactively visit the other government departments working on Vision 2016 and PSG-1 to gain adequate knowledge of the potentials and constraints, and the work environment, in order to be able to provide better support for constitutional implementation;
    Maintain a library of materials on gender and the area of substantive work for the department, and produce user-friendly and operationally-oriented summaries of key documents for broad dissemination in the department, using consultants as necessary.

 

Academic qualifications and Experience

    Minimum of a master’s degree in governance, law, management, politics or a related discipline and at least 5 years of relevant experience  OR a Bachelor’s degree with at least 9 years of relevant experience;
    Demonstrated experience in policy development and support for high level policy processes;
    Demonstrated experience working within the public sector, with previous experience coordinating a complex policy process an advantage
    Experienced at drafting reports, briefings and training materials
    Sound demonstrated understanding of gender issues and principles;
    Fluency in Somali and English (written and oral).

    Position 3: Legal Specialist (Constitutional Affairs)

The Legal Specialist (Constitutional Affairs) will be the focal point within the MOJCA for all constitution-related legislation and policy issues. To this end, the Specialist will:

    Work with the Constitutional Development Department Manager to develop an action plan to guide the work of the Department in support of the MOJCA’s overarching Annual Plan 2014, in particular, in terms of setting out the priorities of MOJCA in supporting constitutional legislation and implementation;
    Lead the MoJCA’s support within the Executive Branch for constitutional review and implementation issues, including constitutional legislation, working closely with the Minister;
    Strengthen the Department’s capacities to develop policies and related-legislation;
    Conduct research on constitutional issues as necessary, and make recommendations for action to the Minster as appropriate;
    Liaise and consult with the Parliament and other stakeholders and civil society on key constitutional legislation as necessary;
    Provide mentoring and training to key staff members and interns to build their capacity to undertake legal research, and develop briefings and policy papers;

 

Academic qualifications and Experience

    Minimum of a master’s degree in law or a related discipline and at least 10 years of relevant experience in law or constitutional affairs OR a Bachelor’s degree in law with at least 10 years of relevant experience;
    Proven expertise in Somali law with legislative drafting experience an advantage;
    Demonstrated experience with policy development;
    Experience working in the public sector is an advantage;
    Experienced at drafting reports, briefings and other materials;
    Sound demonstrated understanding of gender issues and principles;
    Fluency in Somali and English (written and oral).

    Position 4: Civic Education Specialist

The Civic Education Specialist will be expected to work in close collaboration with the Communications, Media and Public Awareness Specialist as well as the National Federal Parliament outreach and education staff, including through participation on the Joint Civic Education Steering Committee. Working in close partnership with the Parliament and members of the Joint Civic Education Steering Committee Provide, the Specialist will:

        Develop a joint Public Outreach and Education Campaign, including designing Somali-appropriate civic education/public information strategies and campaigns;
        Proactively link with other national Ministries as well as regional administrations to implement a country wide civic education campaign;
        Design and deliver special programmes design to target young people and women in particular;
        Design outreach and education materials, including radio programming, pamphlets, posters and a joint national constitutional website;
        Design and oversee implementation of constitutional surveys, in order to track the impact of civic education activities;

 

Qualifications:

    Advanced University Degree (Master or equivalent) in International Studies, Education, Public Policy, Law, or similar field;
    At least 5 years of progressively responsible relevant professional experience in civic education, public outreach or governance assistance;
    Experience working in coordination with national and local counterparts in supporting effective participatory processes;
    Experience working on outreach to women and young people specifically;
    Experience in designing and leading formal trainings, coaching and mentoring as well as public outreach campaigns;
    Experience at the international level, especially in international organizations desirable;
    Fluency in Somali and English (written and oral) is essential.

    Position 5: Communications, Media and Public Awareness Specialist

The Communications, Media and Public Awareness Specialist will be expected to work in close collaboration with the Communications, Media and Public Awareness Specialist as well as the National Federal Parliament outreach and education staff, including through participation on the Joint Civic Education Steering Committee. The Specialist will:

    Provides strategic guidance and leads / supervises media activities and media outreach for the Department and the Joint Civic Education Steering Committee;
    Advises and provides high-quality substantive support to the Department on generating media coverage of constitutional issues, including supervising the production of editorial content and provides quality assurance;
    Supervises the organization of relevant press conferences, drafting of statements and talking points; media monitoring and archiving of coverage; etc.
    Builds communications partnerships and media alliances with a wide network of media organisations, in Somalia and internationally, including corporate contacts of individuals, groups, organizations and media outlets;
    Builds and maintains contacts with counterparts inside the Government to maximize outreach on issues and make efficient use of resources;
    Identifies innovative opportunities and new communications tools and platforms which can serve to highlight the constitutional work of Government;
    Oversees the production of a range of communications materials for the Department and the Joint Civic Education Steering Committee, including managing the website;
    Ensures production of timely, accurate and high-quality informational materials, such as press releases & media advisories, news briefs, fact sheets, stories from the regions, audio and video stories and informational kits for further public outreach;
    Strengthens quality assurance in all communications related work and activities for the Joint Civic Education Steering Committee;

 

Qualifications:

    Master’s degree in communications, journalism, public relations, social sciences, international relations, or a related field.
    A minimum of 5 years relevant experience (post-Masters) in communications at the national or international level, including in-depth experience in communications efforts, media outreach and media partnerships.
    Demonstrated ability to build and nurture strong relations with the media (national and international);
    Proven ability to develop and implement effective communications and media strategies;
    Proven ability to position issues effectively, both orally and in writing;
    Demonstrated excellent editorial skills;
    Demonstrated ability to communicate sensitively, effectively and creatively across different constituencies;
    Fluency in Somali and English (written and oral) is essential.
